Our colleague Aytaç Ünsal, the lawyer of the people who has been continuing the death fast resistance for months for the right to a fair trial, gave a break to the death fast on the 215th day of his resistance after the decision of the Supreme Court of Appeals.
People’s lawyers Ebru Timtik and Aytaç Ünsal were imprisoned for being the peoples lawyers with altogether 16 lawyers, tried on the orders of AKP fascism, and all prisoners lawyers were sentenced to 159 years and 2 months in prison with only secret witness lies in a trial game in which the right to a fair trial was ignored. Ebru Timtik, one of the lawyers of the people who started the death fast by doing the last thing they could do after a long struggle against this lawlessness and injustice, was immortal on the 238th day of her resistance, on August 27, 2020. Aytaç Ünsal, on the other hand, was continuing his resistance in the hospital where he was held by force for more than a month.
The 16th Criminal Chamber of the Supreme Court of Appeals, based on the Forensic Medicine Institute report by the Medical Examiner’s office A decision to release Aytac was made on the grounds that “it would be life-threatening to remain in prison conditions” , which the Istanbul 37th High Criminal Court had not taken into consideration before.
Although we have not yet fully learned the content of the decision, the Supreme Court has also approved the 159 years and 2 months imprisonment imposed on Aytaç and other imprisoned lawyers by ignoring all the unlawfulness and irregularities in the case.
Of course, the Supreme Court’s approval of the penalties imposed on the lawyers of the people means that the lawlessness and injustice will continue, but the release of Aytaç is a gain of the resistance and struggle.
The 16th Criminal Chamber of the Supreme Court turned their back to the demands of a just trial, turn a blind eye to the calls for the reversal of their decision about the unjust and deceit resolve about lawyers. With their inaction, they caused the death of people’s lawyer Ebru Timtik. The rule of the release by the the 16th Criminal Chamber of the Supreme Court is a result of the long running resistance of Ebru and Aytaç, together with the national and international solidarity of the people and struggle surrounding their resistance.
Following months of resistance, we have created an unprecedented struggle for justice in the world. We raised the world with our resistance.
All over the world, Ebru and Aytaç’s justified demands were embraced by their colleagues, lawyers, intellectuals, artists, legal organizations and bar associations. Hundreds of actions and activities have been carried out. The injustice of the AKP judiciary has been exposed all over the world.
Despite all the attacks and threats of AKP fascism in our country, colleagues and bar associations, intellectuals, artists and our people did not stop from embracing Ebru and Aytaç, supporting them, defending their rightful demands and fighting for their freedom. We lost Ebru during our struggle, but we won Aytaç’s freedom through our struggle.
That is why the release of Aytaç is an important victory for us, a victory for our struggle. Of course, our fight for the ultimate victory will continue.
It is our promise to Ebru; now we will continue our fight for justice, for the right to a fair trial, together with Aytaç!
We will win! Because we are right and legitimate!
